1. บทนำ (Introduction)

นโยบายฉบับนี้ถูกร่างขึ้นโดย บริษัท ทเวนตี้โฟร์ ชาร์จ จํากัด (24CHARGE Co., Ltd.) (ซึ่งต่อไปนี้จะเรียกว่า “บริษัท” หรือ “ผู้ให้บริการ”) เพื่อชี้แจงรายละเอียดเกี่ยวกับกระบวนการจัดเก็บ รวบรวม นำไปใช้ ประมวลผล รวมถึงการเปิดเผยข้อมูลส่วนบุคคลของท่าน (“ผู้ใช้งาน”) อันเนื่องมาจากการใช้บริการเช่าพาวเวอร์แบงก์ หรือแบตเตอรี่สำรอง ทั้งนี้ การดำเนินการทั้งหมดจะเป็นไปตามมาตรฐานและข้อกำหนดของพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) เพื่อปกป้องสิทธิและความเป็นส่วนตัวของผู้ใช้งานอย่างสูงสุด

2. ขอบเขต (Scope)

ข้อกำหนดในนโยบายนี้มีผลบังคับใช้กับทุกช่องทางการให้บริการของ 24CHARGE ไม่ว่าจะเป็น แอปพลิเคชันบนมือถือ เว็บไซต์ แพลตฟอร์มการชำระเงิน ขั้นตอนการเช่า-คืนอุปกรณ์ ตลอดจนบริการอื่นๆ ที่เกี่ยวเนื่องกันทั้งหมด

3. การจัดเก็บและรวบรวมข้อมูล (Data Collection)

บริษัทมีความจำเป็นต้องรวบรวมข้อมูลส่วนบุคคลของท่านในประเภทต่างๆ ดังนี้ :

• ข้อมูลเพื่อการยืนยันตัวตน (Identity Data) : อาทิ ชื่อ-สกุล เบอร์โทรศัพท์ อีเมล หรือข้อมูลบัญชีโซเชียลมีเดีย (เช่น LINE) ที่ท่านใช้เชื่อมต่อเพื่อล็อกอินเข้าสู่ระบบ
• ข้อมูลพฤติกรรมการใช้งาน (Usage Data) : อาทิ ข้อมูลประวัติการทำรายการเช่าและคืนอุปกรณ์ พิกัดของตู้ให้บริการที่ท่านไปใช้งาน ระยะเวลาการเช่า ข้อมูลการทำธุรกรรม และรายละเอียดการชำระเงิน
• ข้อมูลเชิงพื้นที่ (Location Data) : อาทิ พิกัดของสมาร์ทโฟนหรืออุปกรณ์ที่ท่านใช้เชื่อมต่อ รวมถึงพิกัดของแบตเตอรี่สำรอง เพื่อประโยชน์ในการติดตามสถานะ ตรวจสอบความถูกต้อง และมอบบริการที่แม่นยำ
• ข้อมูลระบบและเทคโนโลยี (Technical Data) : อาทิ หมายเลข IP (IP Address) รหัสประจำเครื่อง (Device ID) รุ่นหรือประเภทของอุปกรณ์ ระบบปฏิบัติการที่ใช้ และข้อมูลการตั้งค่าเบราว์เซอร์

4. วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล
(Purposes of Data Collection and Use)

บริษัทจะนำข้อมูลส่วนบุคคลของท่านไปใช้ภายใต้วัตถุประสงค์ดังต่อไปนี้ :

• เพื่อส่งมอบบริการเช่าและคืนแบตเตอรี่สำรองให้แก่ท่านได้อย่างราบรื่นและมีประสิทธิภาพ
• เพื่อใช้ในการพิสูจน์ทราบตัวตนของผู้ใช้งาน และป้องกันการกระทำที่เข้าข่ายทุจริต
• เพื่อดำเนินการตัดชำระเงินและออกเอกสารยืนยันการทำธุรกรรม
• เพื่อใช้เป็นช่องทางในการติดต่อ แจ้งข้อมูลข่าวสาร ส่งข้อความเตือน หรือให้ความช่วยเหลือทางเทคนิคแก่ท่าน
• เพื่อนำไปวิเคราะห์และพัฒนาศักยภาพของระบบแอปพลิเคชัน ตู้คีออส และยกระดับประสบการณ์
  การใช้งานโดยรวม
• เพื่อนำเสนอแคมเปญการตลาดและโปรโมชันพิเศษ (Direct Marketing) ในกรณีที่ท่านได้กดยอมรับ
  และให้ความยินยอมไว้
• เพื่อให้สอดคล้องและเป็นไปตามข้อบังคับหรือกฎหมายที่เกี่ยวข้อง

5. สิทธิของเจ้าของข้อมูล (Data Subject Rights)

อ้างอิงตาม พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) ท่านในฐานะเจ้าของข้อมูลมีสิทธิที่จะดำเนินการดังนี้

• สิทธิในการร้องขอเพื่อเข้าถึงและขอรับสำเนาข้อมูลของตนเอง (Right of Access)
• สิทธิในการแจ้งขอปรับปรุงหรือแก้ไขข้อมูลให้เป็นปัจจุบันและถูกต้อง (Right to Rectification)
• สิทธิในการร้องขอให้บริษัทลบหรือทำลายข้อมูลส่วนบุคคลของท่าน (Right to Erasure)
• สิทธิในการขอยกเลิกหรือเพิกถอนความยินยอมได้ตลอดเวลา (Right to Withdraw Consent)
• สิทธิในการขอระงับหรือจำกัดขอบเขตการประมวลผลข้อมูล (Right to Restriction)
• สิทธิในการยื่นเรื่องร้องเรียนต่อคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล หากพบการละเมิด

6. ระยะเวลาในการจัดเก็บข้อมูล (Data Retention)

บริษัทจะดำรงรักษาข้อมูลส่วนบุคคลของท่านไว้ตราบเท่าที่ยังมีความจำเป็นต่อการให้บริการตามวัตถุประสงค์ที่กล่าวมาข้างต้น และสอดคล้องกับกรอบเวลาที่กฎหมายกำหนด เมื่อพ้นกำหนดเวลาดังกล่าว บริษัทจะดำเนินการลบ ทำลาย หรือทำให้ข้อมูลนั้นอยู่ในสถานะที่ไม่สามารถเชื่อมโยงกลับมาระบุตัวตนของท่านได้อีกต่อไป

7. มาตรการรักษาความปลอดภัยของข้อมูล (Data Security)

บริษัทตระหนักถึงความสำคัญในการปกป้องข้อมูลส่วนบุคคลของท่าน จึงได้จัดเตรียมมาตรการรักษาความปลอดภัยทั้งในเชิงเทคนิคและการบริหารจัดการ เพื่อป้องกันมิให้เกิดการเข้าถึง ดัดแปลง นำไปเปิดเผย หรือทำลายข้อมูลโดยปราศจากอำนาจหน้าที่ โดยมาตรการเหล่านี้ครอบคลุมถึง :

• การเข้ารหัสข้อมูลเพื่อความปลอดภัย (Encryption)
• การจำกัดและควบคุมสิทธิในการเข้าถึงข้อมูล (Access Control)
• การเฝ้าระวังและจัดเก็บประวัติการเข้าใช้งานระบบ (Logging & Monitoring)
• ระบบการสำรองข้อมูลและกู้คืนสถานะฉุกเฉิน (Backup & Recovery)

8. การเปิดเผยข้อมูลต่อบุคคลภายนอก (Sharing with Third Parties)

บริษัทอาจมีความจำเป็นต้องส่งต่อหรือเปิดเผยข้อมูลของท่านให้กับบุคคลหรือหน่วยงานดังต่อไปนี้ :

• ผู้ให้บริการภายนอกที่เกี่ยวข้องกับระบบ (เช่น ผู้ให้บริการเซิร์ฟเวอร์, ระบบรับชำระเงิน, ระบบวิเคราะห์ข้อมูล)
• หุ้นส่วนหรือพันธมิตรทางธุรกิจ (ในกรณีที่ท่านได้ให้ความยินยอมไว้แล้วเท่านั้น)
• หน่วยงานของรัฐหรือเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ตามที่มีคำสั่งหรือข้อบังคับทางกฎหมายระบุไว้

9. นโยบายการใช้คุกกี้ (Cookies & Tracking)

บริษัทมีการนำคุกกี้ (Cookies) รวมถึงเทคโนโลยีการติดตามอื่นๆ มาปรับใช้ เพื่อวิเคราะห์พฤติกรรมการเข้าชม พัฒนาการให้บริการ และนำเสนอเนื้อหาหรือโฆษณาที่ตรงกับความสนใจของท่าน ทั้งนี้ ท่านมีสิทธิที่จะปรับเปลี่ยน การตั้งค่าบนเบราว์เซอร์ของท่านเพื่อปฏิเสธการเก็บคุกกี้ได้เสมอ

11. การปรับปรุงนโยบาย (Amendments)

บริษัทขอสงวนสิทธิ์ในการพิจารณาปรับปรุงหรือแก้ไขเปลี่ยนแปลงนโยบายความเป็นส่วนตัวนี้ในอนาคต โดยบริษัทจะดำเนินการแจ้งให้ผู้ใช้งานทราบล่วงหน้าเป็นเวลาไม่น้อยกว่า 7 วัน หากท่านยังคงใช้งานแอปพลิเคชันหรือบริการต่อไปหลังจากมีการประกาศเปลี่ยนแปลง จะถือว่าท่านรับทราบและตกลงยอมรับข้อกำหนดในนโยบายฉบับใหม่เป็นที่เรียบร้อยแล้ว

This Privacy Policy is established by 24CHARGE Co., Ltd. (hereinafter referred to as the "Company" or "Service Provider") to clarify how we collect, use, process, and disclose the personal data of you (the "User") when you use our power bank rental service. All operations comply with the Personal Data Protection Act B.E. 2562 (PDPA) to ensure the highest level of protection for your rights and privacy.

2. Scope

This policy applies to all 24CHARGE service channels, including the mobile application, website, payment platforms, equipment rental and return processes, and all other related services.

3. Data Collection

The Company needs to collect the following types of personal data:

• Identity Data: Your name, phone number, email address, or social media account details (e.g., LINE) used to log into our system.
• Usage Data: Your rental and return history, kiosk locations used, rental duration, transaction history, and payment details.
• Location Data: The GPS coordinates of your smartphone or connected device, as well as the location of the power bank, to track status, verify accuracy, and provide precise services.
• Technical Data: Your IP address, Device ID, device model or type, operating system, and browser settings.

4. Purposes of Data Collection and Use

We use your personal data for the following purposes:

• To deliver seamless and efficient power bank rental and return services.
• To verify your identity and prevent fraudulent activities.
• To process payments and issue transaction receipts.
• To communicate with you, send notifications and alerts, or provide technical support.
• To analyze and improve the performance of our application, kiosks, and overall user experience.
• To offer marketing campaigns and special promotions (Direct Marketing) if you have provided prior consent.
• To comply with applicable laws and regulations.

5. Data Subject Rights

Under the Personal Data Protection Act B.E. 2562 (PDPA), you have the following rights regarding your data:

• Right of Access: To request access to and obtain a copy of your personal data.
• Right to Rectification: To request corrections to keep your data accurate and up-to-date.

11. Amendments
